Terms of Service

1. Eligibility

You must be at least 18 years old to use heyyyy. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Each person may maintain only one account. You agree to notify us immediately of any unauthorized access to your account.

3. The Service

heyyyy is an interactive fiction game featuring AI-powered characters. All characters are fictional and powered by artificial intelligence. heyyyy is not a dating, matchmaking, or relationship advice service.

Interactions with AI characters are for entertainment purposes only and should not be relied upon for personal, professional, or medical advice.

4. Subscriptions & Payments

heyyyy offers auto-renewing subscriptions. Payments are processed through:

• Stripe for web purchases
• Apple In-App Purchase for iOS
• Google Play Billing for Android

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You can cancel your subscription at any time through your account settings or the respective app store.

Refunds are not provided except as required by applicable law or the policies of the Apple App Store or Google Play Store.

Subscription options include weekly, monthly, and annual plans. Current pricing is displayed in the app at the time of purchase. Prices may vary by region and are subject to change.

For iOS users, Apple's Standard End User License Agreement (EULA) applies in addition to these Terms.

5. Acceptable Use

You agree not to:

• Use the service to harass, abuse, or threaten others
• Submit or solicit illegal, harmful, or objectionable content
• Submit photos or images that you do not own the rights to, or that depict other people without their consent
• Use automated tools, bots, or scripts to access the service
• Reverse engineer, decompile, or disassemble any part of the service
• Attempt to circumvent security measures or access restrictions
• Impersonate any person or entity

6. AI-Generated Content

All AI character responses are generated by artificial intelligence and are entirely fictional. AI-generated content does not represent the views or opinions of heyyyyAI Inc.

AI responses should not be treated as professional, legal, medical, or financial advice. heyyyyAI Inc is not liable for any actions taken based on AI-generated content.

7. Intellectual Property

All content, features, and functionality of the service — including AI characters, storylines, graphics, and code — are owned by heyyyyAI Inc and protected by intellectual property laws.

You retain ownership of content you create or submit (such as chat messages and photos you upload), but you grant heyyyyAI Inc a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit that content to third-party service providers as necessary to operate and improve the service, including image moderation and AI image generation features such as Couple Selfie.

By submitting a photo to an image generation feature such as Couple Selfie, you represent that you have the legal right to do so and consent to having that photo processed by our third-party AI providers for the purpose of generating the requested output. See our Privacy Policy for details on which providers receive image data and how long it is retained.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the service or other users. Upon termination, your right to use the service ceases immediately.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, heyyyyAI Inc's total liability to you for any claims arising from or related to the service is limited to the amount you paid to us in the 12 months preceding the claim. In no event shall heyyyyAI Inc be liable for any indirect, incidental, special, consequential, or punitive damages.

11. Dispute Resolution & Arbitration

Any dispute arising from these Terms or your use of the service shall be resolved through binding individual arbitration, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Small claims court exception: Either party may bring qualifying claims in small claims court.

Opt-out: You may opt out of this arbitration agreement by sending written notice to support@heyyyy.ai within 30 days of creating your account.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the service after changes are posted constitutes acceptance of the updated Terms.
